In the petition lodged by Puea Thai spokesman Prompong Nopparit, the Party accused the Prime Minister Abhisit Vejjajiva of negligence of duty for failing to call a meeting of police boards to select the new national police chief before the end of September as earlier scheduled. He claimed that the Prime Minister was guilty of committing criminal offenses under Section 157 of the Criminal Code and violating Sections 16, 17 and 18 (3) of the National Police Act, which stipulates that the Prime Minister must complete the selection of the new national police chief by 30 September. The Prime Minister had then failed to call the board meeting and instead appointed Police General Pateep as acting police chief.

Prime Minister Abhisit Vejjajiva has endorsed the appointment of Inspector-General Police General Pateep Tanprasert as Acting Police Chief on 29 September to replace Police General Thani Somboonsap, who is retiring on 30 September. On the other hand, the selection of the new police chief was indefinitely postponed after the Prime Minister, as the chairman of the police board meeting, had initially failed to gain the majority votes in favor of Police General Pateep, who was his nominee. Another prospective candidate for the top post of the Royal Thai Police is Deputy Police Chief Police General Chumpol Manmai.
